Meeting to Disseminate Study Report and Recommendations for the ‘Reinforcing Thailand’s Anti-Corruption Framework’ Project under Country Programme Phase 2

On August 30, 2024, the Office of the National Anti-Corruption Commission, in collaboration with the Organisation for Economic Co-operation and Development (OECD), organized a meeting to disseminate the study report and recommendations of the Reinforcing Thailand’s Anti-Corruption Framework project. This project is part of the Country Programme (CP) Phase 2 under the main cooperation area of Good Governance. The aim was to inform various sectors and facilitate the implementation of findings within the country, particularly in aligning relevant laws with OECD standards.

The Reinforcing Thailand’s Anti-Corruption Framework project, which began in 2023, has two main objectives: to enhance the capacity of Thailand’s anti-corruption framework in line with OECD standards, and to promote participation in the OECD Working Group on Bribery in International Business Transactions (WGB). The study found that Thailand should consider actions to develop its legal framework and law enforcement regarding international anti-bribery measures. This includes amending Thai laws on foreign bribery offenses and corporate liability to align with convention requirements, considering effective, proportionate, and dissuasive sanctions, introducing additional civil and administrative penalties, and enhancing law enforcement for both individuals and legal entities.

During the meeting, the OECD representative discussed extensive international cooperation in criminal matters related to foreign bribery, including civil and administrative proceedings. They also presented policy recommendations on the non-tax deductibility of bribes paid to foreign public officials or officials of international organizations.

This report and its recommendations, conducted under Country Programme Phase 2, will play a crucial role in enhancing the effectiveness of Thailand’s laws and law enforcement to meet international standards, and in advancing Thailand towards full OECD membership.
